As alcohol retail activity increases uncontrollably which cause high risk of alcohol intoxication, especially in Tet and celebrations, the Government set forth many strict sanctions, forces alcohol trading entities to have license for retail before setting up their business, in order to minimize the risk. Alcohol retail activities at supermarkets, general stores, alcohol stores,… have to be licensed by authorized governmental agency. To help you with the procedure, Thuy Duong Law provides service to apply for the issuance of license for alcohol retail as below:

Legal basis

Decree No. 105/2017/NĐ-CP on the trading of alcohol (taken effect since November 1^st, 2017) supersede Decree No. 94/2012/NĐ-CP, in which states that alcohol retail must be licensed.

Requirements for the issuance of license for alcohol retail

• Applicants are enterprise, co-operative, union co-operative, business household established in accordance with the law;
• Applicants have legitimate use right of fixed business location with detailed address;
• Applicants have introduction documents or principle contracts of alcohol producers, distributors or wholesalers;
• Alcohols for sale satisfy requirements of food safety regulations;
• All requirements of fire and environmental safety are satisfied.

Issuing authority for license of alcohol retail

Economic Department or Economic and Infrastructure Department of People’s Committee of District has the authority to issue license for alcohol retail in the district area.

Note: Agency authorized with issuance also has the authority to amend and complement license.

Dossier for the issuance of license for alcohol retail

• Application form for the issuance of alcohol retail;
• Copy of enterprise registration certificate;
• Copies of lease/borrow contract or other documents proving legitimate use right of facility which is intended to be used as retail location;
• Copies of introduction document or principle contract of alcohol production traders, distributors or wholesalers;
• Receipt of conformity announcement or self-announcement in accordance with the food safety law of liquor products being sale (copy);
• Dossier of fire and environment safety;
• Authorize document for Thuy Duong Law to apply for license of alcohol retail.

Processing duration: 10 -15 workdays (from the receiving date of legitimate dossier).

Some note:

• Effective duration of retail license is 05 years;
• Traders must submit dossier to apply for the reissuance of license at least 30 days before the duration expires. Dossier, authority and procedure for reissuance is as with new issuance.

Administrative violation handling

According to Article 7, 38 Decree No. 185/2013/NĐ-CP dated November 15^th, 2013 of the Government on regulations of administrative violation handling in commerce, production, fake, prohibited product and protection of consumer’s rights, as well as Article 1 (8) Decree 124/2015/NĐ-CP, enterprises can be fined up to 60.000.000 đồng if they do not satisfy the requirements of alcohol trading and distribution.
