PROCEDURES FOR APPLYING AMENDED AMENDMENT OF THE LICENSE FOR SALES AND TRADING OF ALCOHOL.

1.The order of execution

Liquor business enterprises shall submit 01 set of dossier of application for amendment and / or supplement to the liquor wholesale direct sale permit at the OSS replacement unit under the Industry and Trade Department.

+ Within 10 working days after receiving complete and valid dossiers, the competent agencies shall consider and issue the amended and supplemented permits for distribution of liquor products. In case of refusal to grant a certificate, it must reply in writing and clearly state the reasons therefor.

+ In case of not having enough valid dossiers, within 3 working days after receiving the dossiers, the provincial / municipal Industry and Trade Services shall request in writing additional dossiers. Enterprises receive their results at the OSS at the Department of Industry and Trade

3. Composition and number of dossiers Enterprises shall make two sets of dossiers of application for liquor wholesale or retail liquor trading licenses, one set shall be sent to the provincial / municipal Industry and Trade Service and one set shall be kept at the enterprise. A dossier of application for the amendment and supplementation of a liquor wholesale business license comprises:

+ An application for amendment or supplementation;

+ A copy of the liquor wholesale business license

+ Documents evidencing the need for amendment and supplementation.

4. Duration – 10 working days after receiving complete and valid dossiers.

6. Object of implementation The enterprise has been granted a liquor wholesale business license, wishing to amend and supplement the contents of the granted license.

8. Fees and charges

According to the regulations of the Ministry of Finance

(According to Circular No. 77/2012 / TT-BTC dated 16 May 2012 of the Ministry of Finance)

a. Appraisal fee:

+ For business subjects being organizations and enterprises doing business in cities and towns: The assessment fee level: VND 1,200,000 / business place / appraisal.

+ For business subjects being organizations and enterprises operating in the remaining districts: The charge rate for evaluation: 600,000 VND / business point / time of appraisal.

+ For business subjects being business households and individuals in the city or township: VND400,000 / business place / appraisal.

+ For business subjects being business households and individuals in the remaining districts, it is VND 200,000 / business spot / time of appraisal. b. Charge rates:

+ For business spots in the city and towns: Fee rate: VND 200,000 / paper / time.

+ For business locations in the remaining districts: Fee rate: 100,000 VND / paper / time

9. Name of the application, declaration form Application for amendment and supplementation of liquor wholesale business license (according to the form in Appendix 33 to Circular No. 60/2014 / TT-BCT of December 27, 2014). 10. Requirements for implementation

The conditions for granting a liquor wholesale business license include:

+ Being an enterprise set up under the provisions of law and having registered the business of wholesale of alcoholic beverages or trading in alcohol;

+ Having a fixed place of business and clear address, meeting the technical requirements and equipment as prescribed;

+ Having a system of wholesale of liquor products in the provinces where traders are headquartered (at least 3 retailers of liquor products or more);

+ Being directly under the business system of alcohol-producing organizations or individuals or liquor distribution enterprises; Having contracts and documents of introduction of alcohol-producing organizations or individuals or liquor distribution enterprises;

+ Having warehouses (or warehouses) owned or co-owned under joint venture or capital contribution contracts; or have a warehouse lease contract suitable to the business scale of the enterprise (at least the total area must be 50 m2 or more or the volume must be 150 m3 or more) to meet the preservation requirements of the quality of products liquor during storage; Having transport means owned or co-owned under joint venture or capital contribution contracts; or have contracts on hiring transport means suitable to the scale of business of the enterprise (at least one vehicle with a load of 500 kg or more); meet the requirements of preserving the quality of alcohol products during transportation; Having financial capability to ensure the entire distribution system of the normal-operation enterprise (with a bank certificate of at least VND 300 million or more);

+ Having written commitments of enterprises on ensuring full compliance with the requirements on fire prevention and fighting and environmental protection according to the provisions of law;

+ In accordance with Article 18 of Decree 94/2012 / ND-CP dated 12 November 2012.

11. Legal basis of the administrative procedure
