Alcohol distribution is a conditional profession in accordance with the law. Currently, there are several ways of providing alcohol to the market such as import, distribution, wholesale, retail and on-the-spot sales of liquor for consumption. To import liquor, clients have to carry out the procedure to request for a license for liquor import, or license for alcohol distribution in order to distribute wine.

ALCOHOL IMPORT AND DISTRIBUTION LICENSE

Legal basis

Decree No. 105/2017/NĐ-CP on liquor trading (taken effect on 01/11/2017) supersede Decree No. 94/2012/NĐ-CP, in which states that: “import, distribution of alcohol must be licensed”.

Request dossier for issuance of license for import and distribution of liquor

• Form of request for issuance of liquor ditribution license;
• Enterprise registration certificate;
• Lease/Borrow contract or other document proving legitimate use right of warehouse, retail store and on-the-spot sales of liquor for consumption store (enclosing certified copy of land use right certificate);
• Receipt of conformity announcement or certificate confirms that the announcement is in accordance with the food safety law of liquor products being sale (copy);
• Principle contract, confirmation letter or agreement to join the alcohol distribution system of alcohol wholesale traders; license of liquor wholesale of trader who is intending to join the distribution system of applicant;
• Data related to alcohol distributor:

1. Introduction letter or principle contract of alcohol production trader, distribution trader; enclosing list of alcohol intended to be sale;
2. License of production or distribution of alcohol.

• Dossier of fire fighting and prevention and environment protection.

Authority of issuance of alcohol distribution license

Ministry of Industry and Trade issues alcohol distribution license.

Note: agency authorized with issuance of license also has the authority of amend and implement that license.

Processing duration: 15 – 20 workdays, since the date of ligitimate dossier submitted.

Some note:

• Effective duration of distrubution license is 05 years;
• Traders must submit dossier to apply for the reissuance of license at least 30 days before the duration expires. Dossier, authority and procedure for reissuance is as with new issuance.

Administrative violation handling

According to Article 7, 38 Decree No. 185/2013/NĐ-CP dated November 15^th, 2013 of the Government on regulations of administrative violation handling in commerce, production, fake, prohibited product and protection of consumer’s rights, as well as Article 1 (8) Decree 124/2015/NĐ-CP, enterprises can be fined up to 120.000.000 đồng if they do not satisfy the requirements of alcohol trading and distribution.
