Alcohol wholesale in Vietnam is active, especially in big city like Hanoi and Ho Chi Minh City. It used to be quite easy due to the loose management of the government, which lead to the invasion and consumption uncontrollably of fake and unidentified alcohols. As of now, it is required to have license of alcohol wholesale in order to operate.

Legal basis

Dercee 105/2017/NĐ-CP on alcohol trading (taken effect since November 1^st, 2017) supersede Decree 94/2012/NĐ-CP, in which states that: “alcohol wholesale trading must be licensed”.

Dossier for the issuance of license of alcohol wholesale

• Request form for the issuance of license of alcohol wholesale;
• Enterprise registration certificate or other documents of equal legal value (copy);
• Lease/Borrow contract or other documents that prove legitimate use right of facility which is intended to be used as warehouse, retail store or on-the-spot sales of alcohol for consumption store (if there are business activity) according to the law (copy);
• Receipt of confomity announcement or self-announcement of conformity of alcohols intended for business (copy);
• Principle contract, confirmation letter or written commitment of participation of retailers in the wholesale system (3 retailers/province);
• Copy of alcohol retail license of traders who are going to participate in the wholesale system of applicant;
• Documents related to alcohol provider:

1. Copies of introduction documents or principle contracts of native producers, distributors or other wholesalers; in which detailed the alcohols intended for business in accordance with the operation of producers, distributors or other wholesalers;
2. Copies of alcohol production license, distribution license or wholesale license of provider;

• Documents on fire and environmental safety in accordance with the regulations of the headquarter, business locations and warehouses.

Issuing authority for wholesale license of alcohol

Department of Industry and Trde issues wholesale license of alcohol.

Note: The agency with the authority to issue license also has the authority to amend and complement that license.

Processing duration: 10 – 15 workdays (from receiving date of legitimate dossier).

Some note

• Alcohol wholesale license has effective duration of 05 years;
• When overdue, trader must apply for reissuance of license 30 days before the duration expires. Dossier component, authority, procedure for reissuance is as with new issuance.

Administrative violation handling

According to Article 7, 38 Decree No. 185/2013/NĐ-CP dated November 15^th, 2013 of the Government on regulations of administrative violation handling in commerce, production, fake, prohibited product and protection of consumer’s rights, as well as Article 1 (8) Decree 124/2015/NĐ-CP, enterprises can be fined up to 120.000.000 đồng if they do not satisfy the requirements of alcohol trading and distribution, and are forbided to use the wholesale license from 01 – 03 months, depended on the scale of violation.
