• Legal basis: Commercial Law No. 36/2005 / QH11 dated 14 June 2005; Decree No. 67/2013 / NĐ-CP regulates some articles and measures to enforce the tobacco harm reduction law on tobacco business.
• Standards for licensing consideration:
• a) Conditions for granting cigarette product-retail business licenses:
• + Traders that have registered the retail business of tobacco products;
• + Having a fixed place of business and clear address, meeting the technical requirements and equipment as prescribed;
• + Area for cigarette business must be at least 03 m2 or more; Having written introduction, sale and purchase contract of cigarette wholesale enterprises;
• + In line with the planning on tobacco product purchase and sale network approved by competent authorities.
• b) Validity of the license The license for trading in tobacco products shall be valid for 5 years from the date of issuance. A dossier of application for a tobacco retail business license comprises:
• + An application for a retail cigarette retail license;
• + A copy of the enterprise registration certificate or business registration certificate and tax identification number certificate;
• + Copies of the introductory documents, sale and purchase contracts of cigarette wholesale enterprises;
• + File of business location, including: Address, area and description of the tobacco business area; Copies of documents proving the right to use the business location (owned or co-owned or leased for a minimum period of one year);
• List of equipment for checking and adjusting temperature and humidity in cigarette trading areas. The procedure for licensing retail cigarette products:
• a / Competence to grant licenses for cigarette products Industrial and Commercial Offices or Economic Offices (specialized agencies under the People’s Committees of urban districts, rural districts, provincial capitals or towns – hereafter referred to as the Industrial and Commercial Offices), re-grant, Retail tobacco products.
• b / The order and procedures for the granting of permits for purchase and sale of tobacco products:
• + Traders buying and selling tobacco products shall make two sets of dossiers as prescribed above, one set shall be sent to a competent licensing agency and one trader shall retain one set;
• + Within 15 working days after receiving complete and valid dossiers, the licensing agencies shall consider and grant permits for cigarette product purchase and sale. In cases where traders fail to meet the prescribed conditions, competent licensing agencies shall issue written refusals on the granting thereof, clearly stating the reasons therefor;
• + In cases where a valid dossier is incomplete, within 7 working days after receiving the dossier of the trader, the licensing agency shall request the trader to supplement the dossier.
