The procedure for applying for a license for wholesale of tobacco products

1. The order and procedures for the application for a cigarette product wholesale license

* Step 1: Traders buying and selling cigarette products shall apply for a permit to purchase and sell tobacco products, compiling 02 sets of dossiers and 01 set to be sent to the competent licensing agency and traders for retaining 01 set.

* Step 2: Within 15 working days after receiving complete and valid dossiers, the licensing agencies shall consider and grant permits for cigarette product purchase and sale. In cases where traders fail to meet the prescribed conditions, the competent licensing agencies shall issue written refusals on the granting thereof, clearly stating the reasons therefor. If the dossiers are incomplete, within 7 working days after receiving traders’ dossiers, the licensing agencies shall request in writing the traders to supplement the dossiers.

Note: The license for wholesale of tobacco products is valid for 05 years. Prior to the expiry of the 30-day permit, cigarette traders shall submit a dossier of application for re-granting of permit in case of resumption of business. 2. The dossier of application for a cigarette product wholesale license

+ An application for a cigarette product wholesale license, made according to a form provided in Appendix 21 to the Ministry of Industry and Trade’s Circular No. 21/2013 / TT-BCT of September 25, 2013, detailing a number of Articles of the Government’s Decree No. 67/2013 / ND-CP dated June 27, 2013 detailing a number of articles and measures to implement the Law on Tobacco Harm Reduction;

+ A copy of the enterprise registration certificate or business registration certificate and tax identification number certificate;

+ Copies of the introductory documents, purchase contract of cigarette suppliers or cigarette product distributors, clearly stating their intended areas of business;

+ File of business location, including:

– Address, area and description of the tobacco business area;

– Copies of documents proving the right to use the business location (owned or co -owned or rented for a minimum of one year);

– A list of equipment for checking and adjusting the temperature and humidity of cigarette trading areas. + Report on business results of the enterprise:

– A report on the business results of the previous three years, enclosed with a detailed list of lists and valid copies of purchase contracts with each cigarette supplier or tobacco product distribution enterprise. or other wholesale tobacco products, taxes paid;

– Form of sales organization, method of distribution system management.

+ A list of traders, a copy of the enterprise registration certificate or business registration certificate and a tax identification number certificate or cigarette product trading license (if any) whether or not they are part of a distribution system for tobacco products;

+ Documents on transport means, including: Copies of documents proving the right to use means of transport (being owned or co -owned under joint venture contracts, capital contribution or contracts the transport means suitable to the business scale of the enterprise with a minimum lease term of one year);

+ Profile of financial capacity: Having financial capacity to ensure the entire distribution system of the normal operation of the enterprise (with a bank statement);

+ Inventory record (or container area), including:

– Documents proving the right to use the warehouse (owned or co -owned under the joint-venture contract or joint venture capital contribution of the enterprise or leased for use for a minimum of one year);

– The enterprise’s written commitment to ensure full compliance with the requirements on fire prevention and fighting and environmental protection according to the provisions of law for warehouses, made according to a form provided in Appendix 25 promulgated. 3. Agency receiving dossiers – The Industry and Trade Department of the locality where the enterprise is headquartered.

4. Time limit for settlement – 15 working days.

5. Fees – VND 200,000 for the centrally run cities and the cities and towns under the province (according to Point d, Clause 1, Article 2 of Circular No. 77/2012 / TT-BTC dated May 16, 2012 of the Ministry of Finance.
